Terms & Conditions

Effective: 21 September 2026

These terms are intended for business use of Servecture. They include important provisions about local data storage, backups, data recovery and limits of liability.

1. The service

Servecture provides restaurant and hospitality software including Servecture Till and companion applications such as Servecture Waiter, Kitchen and Bar. Functionality may change as the products develop.

2. Local-only operational data

Servecture is designed so the restaurant's operational database is stored locally on restaurant-controlled devices, principally the Till iPad, with authorised companion devices communicating over the local network. Servecture does not provide a cloud-hosted copy or remote recovery service for that operational database.

3. No remote recovery

Servecture cannot remotely retrieve, reconstruct or recover the local operational database if it is deleted, corrupted, overwritten, inaccessible or lost, or if a device is lost, stolen, damaged, reset, replaced or fails. App deletion or reinstallation may also cause loss of locally stored information.

4. Your backup responsibility

The restaurant/operator is responsible for its devices, network, access controls, backups and testing that backups can be restored. Regular backups should be kept separately from the Till device. Servecture must not be the restaurant's only permanent financial, tax or accounting record.

5. Business records and configuration

The restaurant/operator remains responsible for checking prices, orders, discounts, VAT/tax settings, receipts, payments, reports, cash reconciliation and statutory records, and for obtaining appropriate professional advice.

6. Availability and compatibility

Servecture depends on compatible devices, operating systems, network connectivity, permissions, power and, where used, third-party peripherals or services. We do not promise uninterrupted or error-free operation or compatibility with every third-party device or future platform change.

7. Security and authorised use

The restaurant/operator is responsible for device security, staff PINs, Wi-Fi/network security, device passcodes, software updates and ensuring only authorised users have access.

8. Data protection

The restaurant/operator is responsible for personal information it chooses to enter into and control through its local installation, including ensuring an appropriate lawful basis, transparency, retention and security. See our Privacy Policy.

9. Subscriptions

Where a companion application or feature requires a paid entitlement, availability is subject to the applicable subscription and App Store terms and the entitlement remaining valid.

10. Intellectual property

Servecture software, branding, interfaces and related materials remain protected by applicable intellectual-property rights. Users receive a limited right to use the software for lawful business purposes in accordance with these terms and applicable store terms.

11. Disclaimer

To the fullest extent permitted by law, Servecture is supplied on an “as available” basis. The restaurant/operator is responsible for determining whether the software is suitable for its operation and for maintaining appropriate business-continuity, backup and accounting procedures.

12. Limitation of liability

Nothing in these terms excludes or limits liability where it cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that paragraph and to the fullest extent permitted by applicable law, Servecture and its owner, developer, officers, employees and suppliers shall not be liable for loss, corruption or unavailability of locally stored data; inability to recover data; loss of profits, revenue, sales, business, anticipated savings, goodwill or opportunity; business interruption; loss arising from inaccurate or incomplete records; or indirect or consequential loss arising from use of, inability to use, or reliance on Servecture.

To the fullest extent permitted by law, aggregate liability arising out of or in connection with the software shall not exceed the greater of the amount actually paid by the restaurant/operator for Servecture subscriptions during the 12 months immediately preceding the event giving rise to the claim or £100.

13. Indemnity

To the extent permitted by law, the restaurant/operator is responsible for claims, costs or losses arising from its unlawful use of Servecture, its content or data, failure to secure its devices/network, or breach of applicable data-protection, employment, tax or hospitality obligations.

14. Changes and termination

Servecture may be updated, changed or discontinued. Material changes to these terms may require renewed acceptance. Rights and remedies accrued before termination are unaffected.

15. Governing law

Unless mandatory law requires otherwise, these terms are governed by the laws of England and Wales and disputes are subject to the courts of England and Wales.

16. Severability

If a provision is found unenforceable, the remaining provisions continue in effect and the affected provision applies to the maximum extent lawfully permitted.
